RESOLUTION NO. 83 (1989)

RESOLUTION GRANTING THE DIRECTOR OF THE DEPARTMENT OF WATER
SUPPLY, COUNTY OF MAUI, AUTHORITY TO EXPEND FUNDS FOR EMERGENCY
REPAIRS TO WATER WORKS WITHOUT COMPETITIVE BIDDING WHEN PUBLIC
HEALTH, SAFETY OR WELFARE HAS BEEN IMPAIRED OR IMPERILED AS A
RESULT OF AN INTERRUPTION IN THE FURNISHING OF WATER SERVICES 
TO RESIDENTS OF THE COUNTY OF MAUI.



WHEREAS, a continuous, adequate and safe supply of fresh water is essential for the health, 
safety and welfare of the residents of the County of Maui, State of Hawaii; and

WHEREAS, it is imperative that the Department of Water Supply's sources of supply, transmission 
and distribution systems be operated and maintained uninterrupted and in a manner consistent 
with the public health, safety and welfare;

NOW, THEREFORE, BE IT RESOLVED by the Board of Water Supply, County of Maui, State of Hawaii, that 
pursuant to the provisions of Section 103-23, H.R.S., authority is hereby granted to the Director of 
the Department of Water Supply, County of Maui, to expend funds of the Department of Water Supply, 
provided such funds are available, for emergency repairs of water works without competitive bidding, 
and provided further, that the public health, safety or welfare has been impaired or imperiled as the 
result of an interruption in the furnishing of water services to residents of the County of Maui; and

BE IT FURTHER RESOLVED that this resolution shall take effect upon the adoption thereof, and a 
certified copy shall be delivered to the Director of Finance, County of Maui.
