COUNTY OF MAUI BOARD OF WATER SUPPLY RESOLUTION NO. 95-06 (1995)

RESOLUTION RELATING TO DEPARTMENT OF WATER SUPPLY ACCOUNTS



I, the undersigned, hereby certify to BANK OF HAWAII, a Hawaii corporation, 
that I am the chairperson for the Board of Water Supply, County of Maui, 
hereinafter referred to as the "Board", a government unit duly organized and 
existing under the laws of the State of Hawaii and the charter of the County 
of Maui; that the following is a true copy of the resolution adopted by the 
Board of Water Supply at its meeting duly held on the 13th day of June, 1995, 
at which a quorum was present; and that said resolution is in conformity with 
all the applicable laws and Rules and Regulations of the Department of Water 
Supply and are now in full force and effect:

RESOLVED, the BANK OF HAWAII, a Hawaii corporation, is hereby selected and 
designated as a depository of funds of the Department of Water Supply, County 
of Maui, hereinafter referred to as the "Department", and that a checking 
account be established and maintained by and in the name of the Department 
at the said bank, upon and subject to such terms and conditions as the officials 
hereinafter designated, or any of them, may from time to time agree upon with said 
bank; and

FURTHER RESOLVED, that all checks, drafts, withdrawals, and other instruments 
for the payment of money drawn or accepted by this corporation for payment 
from said account or said office be signed on behalf of the Department by any 
one (1) of the following officials: Director, Deputy Director, Fiscal officer, 
or Assistant Fiscal officer; and

FURTHER RESOLVED, that any checks drafts withdrawals, or other instruments 
for the payment of money, endorsed on behalf of the Department for the deposit 
with or collection of said bank, may be so endorsed in the name of the Department 
by written or stamped endorsement, without designation or signature of the person 
making such endorsement; and

FURTHER RESOLVED, that the Chairperson for the Board be and is hereby authorized 
and directed to certify to said bank that the resolution has been duly adopted, and 
is in conformity with the charter of the County of Maui, and to further certify to 
said bank the names and specimen signatures of the present officials of the Department 
authorized to sign as aforesaid, and if and when any change be made in the personnel 
of said officials, the fact of such change and the name and specimen signature of 
each new official shall be submitted to said bank; and

FURTHER RESOLVED, that said bank be and hereby is requested and authorized to honor, 
receive or pay any such instrument signed or endorsed in accordance with the foregoing 
resolution and certification then in effect as above provided for, including any such 
instrument drawn or endorsed to the personal order of, or presented for negotiation or 
encashment by, any official signing or endorsing the same; and

FURTHER RESOLVED, that these resolutions shall remain in full force and effect, 
and said bank shall be fully protected in relying and acting thereon, until a 
certified copy of a resolution of the Board of Water Supply modifying or rescinding 
these resolutions or any part thereof shall have been received by said bank at its 
said office.
