RESOLUTION NO. 03 (1998)

RESOLUTION PROVIDING FOR ACQUISITION OF PROPERTY
BY EMINENT DOMAIN OVER PORTIONS OF NAPILI, MAUI, HAWAII



	BE IT RESOLVED by the Board of Water Supply, County of Maui:

	That for public use and purposes, to wit, the installation of storage 
tanks, source wells, pumps, and pipelines to service consumers on the Board of 
Water Supply's Napili Water System, proceedings of eminent domain as provided by 
law be instituted for the acquisition of property for water system purposes, 
hereinafter described as Lot B of the Alaeloa Tank Site Subdivision as described 
in Exhibit "A", Lot C (Tank Site) of the Alaeloa Tank Site Subdivision as described 
in Exhibit "B", Easement B of the Alaeloa Tank Site Subdivision as described in 
Exhibit "C", Lot 1 (Napili Well C) of the Honokahua Wells Subdivision as described 
in Exhibit "D", Lot 2 (Honokahua Well A) of the Honokahua Wells Subdivision as 
described in Exhibit "E", Lot 3 (Honokahua Well B) of the Honokahua Wells Subdivision 
as described in Exhibit "F", Easement A of the Honokahua Wells Subdivision as described 
in Exhibit "G", Easement B of the Honokahua Wells Subdivision as described in Exhibit "H", 
and Easement C of the Honokahua Wells Subdivision as described in Exhibit "I", all 
aforementioned attachments made a part hereof, and that the Corporation Counsel of 
the County of Maui be and is hereby authorized and empowered to institute such 
proceedings together with the right of ingress and egress from the property.

	The acquisition of the foregoing property by eminent domain is necessary for 
the aforesaid public use and purpose.

	That in the process of said proceedings in eminent domain, the said Corporation 
Counsel is hereby authorized and empowered to negotiate terms of a settlement subject 
to approval of the Board and/or the County before which such proceedings are commenced.

	IN WITNESS WHEREOF, I have hereunto subscribed may name and affixed the seal 
of the Board of Water Supply this 6th day of April, 1998.
