AMENDING RESOLUTION NO. 11 (1998)

A RESOLUTION OF THE COUNTY OF MAUI BOARD OF WATER SUPPLY 
AMENDING RESOLUTION NO. 11 (1998) TO INCLUDE
GENERAL OBLIGATION BOND FUNDING FOR 1998 AND 1999 PROJECTS




	WHEREAS, the County of Maui Board of Water Supply previously approved 
Resolution No. 11 (1998) entitled: A Resolution of the County of Maui Board of 
Water Supply Requesting the County of Maui to Authorize on Behalf of the Department 
of Water Supply, a Semi-Autonomous Department, the Issuance in an Amount Not to 
Exceed Twelve Million Dollars ($12,000,000) Aggregate Principal Amount of General 
Obligation Bonds of the County of Maui for the Purpose of Providing Funds to Pay for 
All or a Part of the Cost of Constructing and Acquiring Capital Improvements as 
Identified in the Fiscal Year 1998 Budget of the Department of Water Supply, Including 
the Acquisition of Any Necessary Land Therefor; and

	WHEREAS, Resolution No. 11 (1998) authorized a bond issuance of an amount 
not to exceed twelve million dollars ($12,000,000); and

	WHEREAS, it has been determined that part of the proceeds of the General 
Obligation Bonds of the County of Maui, heretofore issued, is in excess of the 
amounts required for the purposes for which such bonds were issued, or may or should 
not be applied to those purposes, and directed to other public improvement or authorized 
purposes of the Maui County Board of Water Supply; and

	WHEREAS, the Board desires to amend Resolution No. 11 (1998) to allow for the 
funding of 1998 and 1999 Capital Improvement Projects; and

	WHEREAS, it is in the best interest of the Board to apply the proceeds of 
the bonds issued pursuant to the ordinance which is in excess of, or shall not be 
applied to, purposes of the ordinance to pay the cost of appropriations for other 
public improvements;

	THEREFORE, BE IT RESOLVED, by the Maui County Board of Water Supply that
it hereby determines that a portion of the proceeds of the general obligation 
bonds of the County issued pursuant to Ordinance No. 2678 is in excess of the 
amount required for the purposes provided in said ordinance for which bonds were 
issued, or may or should not be applied to those purposes and directed to other 
public improvements or authorized purposes of the Maui County Board of Water Supply, 
and such amount shall be reallocated to finance the appropriation for capital 
improvement projects of the Maui County Board of Water Supply Capital Improvement 
Budgets for fiscal years ending June 30, 1998 and June 30, 1999 and authorizes the 
Director to submit a list of such projects (Exhibit "A") to the County Council.

	This Resolution shall take effect upon the adoption thereof, and a certified 
copy shall be delivered to the Mayor and to the County Council.
