COUNTY OF MAUl, BOARD OF WATER SUPPLY RESOLUTION NO. 19 (1998) RESOLUTION GIVING AUTHORITY TO THE DIRECTOR TO ENTER INTO INTERGOVERNMENTAL LOAN AND GRANT AGREEMENTS WITH THE UNITED STATES DEPARTMENT OF AGRICULTURE RURAL DEVELOPMENT SERVICE REGARDING THE ULUMALU-PEAHI WATER SYSTEM IMPROVEMENTS AND THE NECESSARY COLLATERAL AGREEMENTS WITH RECIPIENTS OF THE LOANS AND GRANTS WHEREAS, the United States Department of Agriculture, under the Rural Utilities Service (RUS), provides for federal assistance in the form of low interest loan and grant monies under the RUS's Water and Waste Disposal Loans and Grants Program; and WHEREAS, the Board is continually pursuing compliance with applicable federal and statc laws to providc its consumcra with high quality drinking water; and WHEREAS, the Board's capital improvement program reflects the need to utilize all funding resources available to construct the necessary improvements; and WHEREAS, pursuant to Chapter 11, Charter of the County of Maui, the Board is charged with the management of the Department of Water Supply. WHEREAS, the Director for the Department of Water Supply is charged with the administration of the Department's affairs and is responsible for the day-to-day management; WHEREAS, the Board may delegate its ministerial duties and responsibilities to the Director; and WHEREAS, the signing of loan documents are ministerial in nature; now therefore, BE IT RESOLVED by the Board of Water Supply, County of Maui: 1. That the Director be authorized to request for and execute loan/grant applications and agreements, including collateral agreements, for the planning, design, and construction of certain drinking water projects pursuant to the rules and regulations of the United States Department of Agriculture Rural Utilities Service regarding the Ulumalu-Peahi water system improvements. 2. That either the Director or the Deputy Director is authorized to sign the necessary Federal Rural Utilities loan and grant documents up to $2.5 million. BE IT FURTHER RESOLVED that the secretary be directed to provide certified copies of this Resolution to the Director and Deputy Director of the Department of Water Supply, the Fiscal Officer, Mayor, Maui County Council, and the appropriate governmental agencies.
