COUNTY OF MAUI, BOARD OF WATER SUPPLY RESOLUTION NO. 21 (1998) AUTHORIZING THE DIRECTOR AND THE DEPUTY DIRECTOR OF THE DEPARTMENT OF WATER SUPPLY, COUNTY OF MAUI, TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT FOR A STATE REVOLVING LOAN (DRINKING WATER PROJECTS) WHEREAS, the Nineteenth Legislature of the State of Hawaii enacted Act 218 to provide for the creation of a State Revolving Fund for the purpose of protecting and improving drinking water quality by financing eligible projects consistent with applicable federal and state laws; WHEREAS, under the terms and conditions anticipated with regard to the State Revolving Fund Loan, the Board of Water Supply (Board) shall repay over a term of twenty years the principal amount which shall not exceed $12.0 million, including interest at a fixed rate plus an administrative fee, equal to less than the bond market prime rate as indicated in the most recent publication of The Bond Buyer; and WHEREAS, the Board is continually pursuing compliance with applicable federal and state laws to provide its consumers with high quality drinking water; and WHEREAS, the Board's capital improvement program reflects the need to utilize all funding resources available to construct the necessary improvements; and WHEREAS, pursuant to Chapter 11, Charter of the County of Maui, the Board is charged with the management of the Department of Water Supply; and WHEREAS, the Director for the Department of Water Supply is charged with the administration of the Department's affairs and is responsible for the day-to-day management; and WHEREAS, the Board may delegate its ministerial duties and responsibilities to the Director; and WHEREAS, the signing of loan documents is ministerial in nature; now, therefore, BE IT RESOLVED by the Board of Water Supply, County of Maui: That the Director be authorized to request for and execute State loan/grant applications and agreements for the planning, design, and construction of certain drinking water treatment projects to achieve or maintain compliance with the Safe Drinking Water Act; and That either the Director or the Deputy Director is authorized to sign the necessary State Revolving Fund loan documents up to $12.0 million. BE IT FURTHER RESOLVED that the Secretary be directed to provide certified copies of this Resolution to the Director and Deputy Director of the Department of Water Supply, the Fiscal Officer, Mayor, Maui County Council, and the Director of the State Department of Health.
