Repair and Replacement of Improvements

Prior to acceptance, the subdivider shall enter into an agreement with the department and shall file with the director a surety bond or other approved bond to insure the repair and replacement of subdivision water system improvements in accordance with standards acceptable to the department for a period of one year from the date of dedication to and acceptance by the department. The amount of the surety bond or other approved bond shall be at least ten percent of the cost of construction as estimated by the director.
